Terms of Service

Terms of Service

By engaging in a commission and making a payment, you ("the Commissioner") agree to be bound by the following Terms of Service ("Agreement") between you and Berrysquid ("the Artist"). Please read this Agreement carefully before proceeding with your order.

  • The Artist reserves the right to refuse any order without detailed explanation

  • The Artist may revise these Terms at any time; ongoing projects will be notified of changes.

  • By continuing to use the Artist's ongoing or completed services, the Commissioner agrees to any revisions in the Terms.

Payment

  • Upon accepting the commission, the Artist will send an invoice via PayPal to receive payment.

  • Payment must be completed upfront for commissions <$1000 USD.

  • For commissions >$1000 USD, 50% may be completed upfront and 50% may be completed after the Artist sends the initial sketch to the Commissioner.

  • Upon receiving the invoice, the Commissioner is responsible for completing payment in a timely manner. If payment is not received within the agreed timeline, the Artist reserves the right to cancel the commission.

Process and Timelines

  • The Artist will provide a sketch for approval after receiving payment. Afterwards, WIPs may be sent at the Artist's discretion or requested at the Commissioner's discretion.

  • Major changes after the initial sketch phase will incur additional charges. The Commissioner will be notified of additional costs and must provide approval before the revisions are made.

  • Minor changes, within reason, may be requested throughout the commission free of charge.

  • Expected timeline for commissions may vary, generally taking ~2-4 months. The Artist and Commissioner may discuss specific deadlines, including rush deadlines for an additional fee, subject to the Artist's availability.

Usage Rights and Privacy

  • Artist's Use & Privacy: The Artist reserves the right to use the completed commission for personal and commercial uses (e.g., Patreon, fanart merchandise). Commissioners may request to keep the commission private for a 15-30% upcharge depending on level of privacy.

  • Non-Commercial Use: The Commissioner will receive a low and high resolution .png of the file. The Commissioner may freely upload the file on non-monetized platforms such as ToyHouse or social media, though discretion is advised when publicly sharing the high-resolution file.

  • Use on Monetized Platforms: In addition to non-commercial use rights, the Commissioner may upload the low or high resolution file on monetized platforms such as YouTube and Twitch. This category will be charged 1.5x the base price of non-commercial commissions.

  • Use for Merchandizing: In addition to right to use on monetized platforms, the Commissioner will receive the full working file for the commission and may print and distribute the work for profit. This category will be charged 2.5x the base price of non-commercial commissions.

  • Small & Large Businesses: Please inquire directly for additional usage and pricing details.

  • The Commissioner is required to disclose their intended use for the commission, and the Artist is required to give written agreement. Changes in usage rights after completion of the commission must be brought to the Artist to settle

Refunds

  • Upon initiating the commission, refunds will not be given unless the Artist is unable to complete the commission. The Commissioner thereby agrees not to file a chargeback claim against the Artist.

  • If the Artist is unable to complete the commission due to exceptional circumstances, a partial refund will be offered based on the level of completion for the commission.

  • If the Commissioner directly violates the terms of this Agreement, the artist reserves the right to cancel the commission without refund.
